1、 Definition

2.2 supplementary agreement

Due to the rapid development of the Internet, the terms of this agreement signed by you and agapios can not completely list and cover all rights and obligations of you and agapios, and the existing agreements can not guarantee that they fully meet the needs of future development. Therefore, the relevant statements and policies published by agapios, agapios rules and agreements are supplementary agreements to this agreement, which are inseparable from this Agreement and have the same legal effect. If you use agapios service, you are deemed to agree to the above supplementary agreement.

3、 Account registration and use

3.1 user qualification

You confirm that you should have civil capacity before you start using / register the agapios service. If you do not have the capacity for civil conduct, you and your guardian shall bear all the consequences arising therefrom in accordance with the law.

In particular, if you are a minor, stop using agapios.

3.2 account description

When you fill in the information, read and agree to this Agreement and complete the registration process, you can obtain the agapios account and become a agapios user.

You have the right to log in to agapios using the agapios user name you set or confirmed (hereinafter referred to as "account name") and the password you set (account name and password collectively referred to as "account"). As your agapios account is associated with your personal information and agapios business information, your agapios account is only for your own use. Without agapios's consent, you directly or indirectly authorize a third party to use your agapios account or obtain the information under your account, and agapios will not be responsible for all the consequences caused by your behavior. However, if agapios determines that the use of your agapios account may endanger your account security and / or agapios information security, agapios may refuse to provide the corresponding services or terminate this agreement. Any illegal, untrue and inaccurate user information shall be borne by you. The account name you set must not violate the management provisions of laws and regulations and agapios rules, otherwise agapios may suspend or cancel your account name, and report to the competent authority.

If it is found that the user-defined name such as account number registered or used in the software is the same as that of other users, agapios has the right to ask you to modify the above name. If you do not modify it within the time limit required by agapios, agapios has the right to mark the user-defined name to distinguish it, so as to ensure the normal operation of the software (such as the account name you want or are using) It is called "agapios", but there is also another user account named "agapios" in the same group of servers. If you are not willing to change the name, agapios has the right to add an identifier after your name to become "agapios1", "agapios2" and so on without your consent. You agree and authorize that, in order to provide better services for you and ensure the security of your account, agapios can initiate a query on the authenticity of the user's identity and the validity status of the user's mobile phone number according to the mobile phone number and other information provided by you.

3.3.2 update and maintenance

You should timely update the information you provide (including but not limited to registration information) to ensure that it meets the requirements of timeliness, detail, authenticity and accuracy. In the case that the law clearly requires agapios to verify the information of some users, agapios will check and verify your information from time to time according to law, and you shall cooperate to provide the latest, true and complete information. When you change or delete the relevant information, you may also lose the text, picture, video, etc. stored in the system. agapios is not responsible for the loss of content caused by your own operation. If agapios fails to contact you according to the last information provided by you, you fail to provide information in time as required by agapios, the information provided by you is obviously untrue or the information provided by you is verified invalid by the administrative and judicial authorities, you will bear all losses and adverse consequences caused to yourself, others and agapios. agapios may send you a notice of inquiry or request for rectification, and require you to recertify until you suspend or terminate the provision of part or all of agapios's services to you, and agapios shall not be responsible for this.

3.3.3 account security specification

Your account is set up and kept by you. agapios will not ask you for your account password at any time. Therefore, it is recommended that you take care of your account and make sure that you log out at the end of each online session and leave agapios in the correct steps.

You are responsible for the losses and consequences caused by your active disclosure or other attacks and fraud. agapios does not assume responsibility, you should seek compensation from the infringer through judicial, administrative and other relief channels.

Your account can only be used by yourself. It can not be lent, donated, rented, transferred, sold or shared by others without following the prescribed procedures. When your account is used without authorization, you should inform agapios immediately. Otherwise, unauthorized use will be regarded as your own behavior, and you will bear all losses and consequences caused by it. Except for agapios's fault, you shall be responsible for all behavior results under your account (including but not limited to signing various agreements online, publishing information, purchasing goods and services and disclosing information, etc.). If you find any unauthorized use of your account to log in to agapios or other circumstances that may cause your account to be stolen or lost, you are advised to inform agapios immediately. agapios shall not be held responsible for any action that agapios may have taken to prevent you from taking reasonable action, except that agapios is unable to take reasonable action against you.

4、 agapios service and specification

4.1 agapios services

Agapios provides you with services including but not limited to the following:

4.1.1 any website directly owned or operated by agapios, such as agapios.net (and any other website operated by agapios);

4.1.2 the clients directly owned or operated by agapios include but are not limited to the clients of all terminals such as PC, tablet, mobile phone, TV, set-top box, etc;

4.1.6 Agapios search service;

4.1.7 Agapios remote operation game console service;

agapios service is only used by you in agapios. Any act of separating agapios service from agapios by malicious cracking and other illegal means does not belong to the agapios service agreed in this agreement. The only legal way to register, log in, download and use agapios's service is officially announced by agapios website. You understand and acknowledge that agapios enjoys the following rights. 4.2 service specification

The ownership of agapios's account is owned by agapios. After you complete the registration application, you will get the right to use agapios's account, which belongs to the initial applicant only. You are obliged to keep the account and password obtained when you register and use agapios, and be responsible for a series of actions or activities started after the group account and password log into the system. Due to the particularity of the network service, agapios does not audit whether to use the group account and password for you, only check whether the account and password are consistent with those saved in the database. As long as the account and password entered by anyone are consistent with those saved in the database, they can log in to agapios with the account and password. If the user is not the initial application registrant of the account, agapios has the right to freeze and recover the account without notice without any legal liability to the user of the account. Unless the contrary is proved, agapios considers you to be the copyright owner of the content you upload, publish or transmit on agapios. By using agapios service to upload, publish or transmit the content, you have the right and agree to transfer all intellectual property rights (including but not limited to copyright, trademark and other intellectual property rights) of all the content (including but not limited to video, audio, and any text, video, audio, etc. related to this agreement, hereinafter referred to as the "anchor achievement") And all related derivative rights) and related rights and interests, which are granted to agapios worldwide, irrevocably and free of charge from the date of upload, release or transmission. Without the prior written consent of agapios, you shall not use or provide or authorize any third party to use it in any way (including but not limited to publishing in video, game live broadcast, game website and other third parties) and obtain any income.

To facilitate your use of agapios and agapios's related services, you authorize agapios to transfer the information provided and formed by you in the process of account registration and use of agapios's services to agapios's related companies and other relevant service providers, or obtain the information provided and formed by you during the registration and use of the related services from agapios's related companies and other relevant service providers.

The legal disputes caused by your business activities with others in agapios shall be handled by both parties themselves, and agapios shall not bear any responsibility.

If you release news information, you understand and confirm that you have the qualification of Internet news information service, and the news information released is true, accurate, objective and fair. The reprint of news information shall be complete and accurate, the content of news information shall not be distorted, and the source shall be indicated in a prominent position to ensure the traceability of news information source. agapios has the right to review the news information released by you. If you publish false news or you do not have the qualification to publish, agapios has the right to restrict the scope and objects of dissemination of your published content, restrict or prohibit you to use all or part of agapios's services, cancel your account, save relevant information according to laws and regulations and report to relevant departments.

agapios will not endorse, recommend or express opinions on any content and information uploaded, published or transmitted by you on agapios, nor shall agapios be liable for any errors, defects, losses or damages of any content and information, and you shall bear the relevant risks for any use of the content and information.

You agree that agapios will post commercial advertisements or other commercial information of any kind in various ways in the process of providing services (including but not limited to placing advertisements in any location of agapios and advertising in the content you upload and disseminate), and you agree to accept agapios sending you promotions or other forms of promotion through e-mail, on-site messages, SMS, website announcements or other means His business information. Meanwhile, agapios has the right to add the website logo (or name) and time watermark mark in the live room. agapios will do its best, but does not guarantee that it will not affect your live experience.

You should restrict your user behavior on agapios and ensure your personal safety and property safety in the process of live broadcast online. 4.4 prohibited acts

You understand and warrant that you will not engage in the following prohibited acts in respect of agapios services, nor will anyone use your account to do the following:

1) When registering an account, or using agapios service (including but not limited to uploading, publishing, disseminating information, etc.), impersonating others or institutions, or falsely claiming that you have contact with any person or entity (including setting false account name or accessing another user's account), or you maliciously use the registered account to cause other users to misunderstand;

5、 Intellectual property

Unless otherwise agreed or otherwise stated by agapios, all intellectual property rights (including but not limited to copyright, trademark right and exclusive right) of all contents (except those copyrighted by users according to law), technology, software, program, data and other information (including but not limited to words, images, pictures, photos, audio, video, charts, colors, layout, electronic documents) in agapios Interests, trade secrets, etc.) and related rights belong to agapios or agapios's affiliated companies. 6、 User's breach of contract and treatment

For example, agapios can determine whether you constitute a breach of contract according to the relationship between your user data and massive user data; you are obliged to provide sufficient evidence and reasonable explanation for your data anomalies, otherwise it will be deemed as breach of contract.

7.2 measures for breach of contract

If the content and information you publish on agapios constitutes a breach of contract, agapios can immediately delete and block the corresponding content and information according to the corresponding rules, or suspend the use of your account, seal up, freeze or empty virtual gifts, or cancel. If your actions on agapios or those not implemented on agapios but have an impact on agapios and its users constitute a breach of contract, agapios can restrict your account from participating in activities and suspend providing some or all services to you (such as sealing up virtual live room, freezing or emptying virtual gifts, deducting liquidated damages, etc.) according to the corresponding rules. If your actions constitute a fundamental breach of contract, agapios may seal up your account and terminate its services to you. If your account is sealed up, the power, game currency, virtual gifts and other virtual products in your account will be emptied, and relevant virtual product services will be terminated.

If your behavior on agapios violates the relevant laws and regulations, agapios can report to the relevant competent authority and submit your use record and other information according to law. At the same time, agapios can publish the information on the above measures for handling your breach of contract and other illegal information confirmed by the effective legal documents of the state administrative or judicial organs on agapios. In addition, agapios can carry out blacklist management and credit management on you in accordance with relevant national laws and regulations, and provide management and services linked with credit rating. If you are included in the blacklist, agapios has the right to take measures against you who are included in the blacklist to prohibit re registration of account number, and report to relevant departments in a timely manner.

7.3 liability

If your behavior causes agapios and / or its affiliated companies to suffer losses (including but not limited to its own direct economic loss, goodwill loss and indirect economic losses such as compensation, settlement payment, lawyer's fees, litigation costs and other indirect economic losses), you shall compensate agapios and / or its affiliated companies for the above-mentioned losses. If your behavior causes agapios and / or its affiliated companies to suffer the claim of a third party, agapios and / or its affiliated companies can recover all the losses from you after assuming the obligation of money payment to the third party.

7.4 special agreement

If you provide benefits in kind, cash, cash equivalents, services, tourism, etc. to the employees or consultants of agapios and / or its affiliated companies, which are obviously beyond the scope of normal business negotiation, you can be regarded as having commercial bribery.

In case of any of the above situations, agapios may immediately terminate all cooperation with you and charge you liquidated damages and / or compensation based on the economic loss and goodwill loss suffered by agapios due to your bribery.

agapios is responsible for providing agapios services to you in "as is" and "available" status. agapios shall bear the corresponding obligations according to the law, but shall not be liable for the damage caused to you by the maintenance of information network equipment, connection failure, computer, communication or other system failure, hacker activity, computer virus, power failure, strike, riot, fire, flood, storm, explosion, war, government action, order of judicial administration or third party assumed liabilities.

agapios does not guarantee that the services controlled or provided are appropriate and feasible in other countries or regions. Any user using agapios services in other jurisdictions shall ensure that it complies with local laws and regulations, and agapios shall not be responsible for this.

7、 Change of agreement

agapios may modify this Agreement and supplementary agreement from time to time according to the needs of changes in national laws and regulations and agapios's service changes. The changed agreement and supplementary agreement (hereinafter referred to as "change items") will be notified to you in the way specified in Article 10 of this agreement. Once the updated terms of the agreement are published, they will replace the original terms.

If you do not agree to the change, you shall stop using agapios service from the effective date of the change; if you continue to use agapios service after the change takes effect, you shall be deemed to have agreed to the effective change.

8、 Notice

You agree that agapios will deliver all kinds of notices to you in the following reasonable ways:

（1） Public copy;

（2） In station message, pop-up message and client push message;

（3） Email, SMS, letters, etc. sent according to your reserved contact information in agapios;

If agapios sends a notice to you in the above way, it will be deemed to have been delivered when it is successfully sent; if the written notice is sent by paper carrier, it will be deemed to have been delivered on the fifth natural day after it is delivered to the post according to the contact address provided.

However, it is not limited to the service of documents to the court by email (not limited to the service of legal documents to the court by email, not limited to the service of legal documents to the court through email, etc.). The mobile phone number, e-mail address and other contact information you specify to receive legal documents are the mobile phone number and e-mail contact information provided by you when you register and update with agapios. The legal document issued by the judicial organ to the above contact information is deemed to be delivered. The mailing address you specify is your legal contact address or the valid contact address provided by you.

You agree that the judicial authorities may take one or more of the above service methods to reach legal documents for you, and the judicial organs may serve legal documents on you in various ways, and the service time shall be subject to the first service among the above service methods.

You agree that the above method of service is applicable to all stages of judicial proceedings. For example, those who enter the litigation procedure include but are not limited to the procedures of first instance, second instance, retrial, execution and supervision.

You should ensure that the contact information provided is accurate, effective and updated in real time. If the legal documents can not be delivered or not delivered in time due to the inaccurate contact information provided or the changed contact information is not timely informed, you are responsible for the possible legal consequences.

9、 Termination of agreement

10.1 circumstances of termination

You have the right to terminate this agreement in any of the following ways:

（1） You cancel your account through the website when meeting the clearing conditions such as account cancellation published on agapios website;

（2） Before the change takes effect, you stop using it and express your unwillingness to accept the change item;

（3） You express that you do not want to continue to use agapios services and meet agapios's termination conditions.

agapios may terminate or terminate this agreement by giving you notice in the manner set out in Section 10 of this agreement if:

（1） If you violate this agreement, agapios will terminate this agreement according to the breach clause

（2） You transfer your own account, embezzle another's account, provide false registered identity information, publish prohibited content and information, defraud others' property, and take improper means to seek profits, etc. agapios has sealed your account according to agapios rules;

（3） In addition to the above circumstances, because you have repeatedly violated the relevant provisions of agapios rules and the circumstances are serious, agapios has sealed your account according to agapios rules;

（4） Your account is cancelled by agapios in accordance with this agreement;

（5） You have infringed upon the legitimate rights and interests of others or other serious violations of the contract in agapios;

（6） Other circumstances in which agapios shall terminate the service in accordance with relevant laws and regulations.

10.2 treatment after termination of the agreement

Upon termination of this agreement, except as expressly provided by law, agapios shall not be obliged to disclose any information in your account to you or to a third party designated by you.

Upon termination of this agreement, agapios shall have the following rights:

（1） Stop collecting and using your personal information, but you can continue to save other content and information you keep in agapios;

（2） For your past breach of contract, agapios can still hold you responsible for breach of contract in accordance with this agreement.

10、 Application of law, jurisdiction and others

The conclusion, effectiveness, interpretation, amendment, supplement, termination, execution and dispute settlement of this Agreement shall be governed by national laws; if there are no relevant provisions in laws, commercial practices and / or industry practices shall be referred to.

Disputes arising from your use of agapios service and related to agapios service shall be settled by agapios through negotiation with you. If the negotiation fails, either party may bring a lawsuit to the court where agapios is located.

Any provision of this Agreement shall be deemed invalid, invalid or unenforceable, and such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions of this agreement.
